Please read these Terms & Conditions (“Terms”) carefully before using whainc.org (the “Site”), operated by Wisconsin Hmong Association, Inc. (“WHA,” “we,” “us,” or “our”).

1. Agreement to These Terms

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Site.

2. Who May Use the Site

The Site is intended for general audiences. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. Registration for programs on behalf of a minor must be completed by a parent or legal guardian.

3. Our Content and Intellectual Property

Unless otherwise noted, all content on the Site — including text, graphics, logos, photographs, video, and the arrangement of that content — is the property of WHA or its content suppliers and is protected by United States and international copyright and trademark law.

You may view, download, and print content from the Site for your own personal, non-commercial, educational use, provided you do not remove any copyright or attribution notices. You may not reproduce, republish, distribute, sell, or create derivative works from our content for commercial purposes without our prior written permission.

The Wisconsin Hmong Association name and logo are our trademarks and may not be used without our written permission.

4. Cultural and Historical Content

Portions of the Site present Hmong history, language, traditions, and cultural practices. This material is shared for educational purposes and in a spirit of cultural preservation. Hmong cultural knowledge is diverse and varies among families, clans, regions, and generations; the accounts presented here reflect commonly shared understandings and are not the only valid perspectives. We ask that you engage with this material respectfully and not represent it as exhaustive or as the sole authority on Hmong culture.

5. Your Submissions

If you submit content to us — including comments, photographs, stories, or messages — you represent that you own it or have the right to share it, and that it does not infringe anyone else’s rights. You grant WHA a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our programs, communications, and mission, unless you tell us otherwise in writing.

We reserve the right, but assume no obligation, to review, edit, or remove any submission at our discretion, including comments that are off-topic, abusive, or spam.

6. Acceptable Use

When using the Site, you agree not to:

• Violate any applicable law or regulation
• Post or transmit content that is unlawful, harassing, defamatory, discriminatory, obscene, or threatening
• Impersonate any person or organization, including WHA staff or volunteers
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Introduce viruses, malware, or any other harmful code
• Use automated tools to scrape, harvest, or collect information from the Site, including email addresses
• Interfere with or disrupt the Site or the networks it relies on
• Use the Site to send unsolicited commercial messages

7. Programs, Classes, and Events

Information about our programs, classes, and events is provided for general purposes and may change. Registering interest through the Site or by email does not by itself guarantee a place in any program.

Participation in certain programs or events may require you to sign a separate agreement, waiver, media release, or code of conduct. Where a separate agreement applies, that agreement governs your participation.

We reserve the right to reschedule, modify, or cancel any program or event, and to decline or end participation where conduct is inconsistent with our values or the safety of participants.

8. Volunteering

Expressing interest in volunteering does not create an employment relationship, an offer of employment, or any contractual obligation between you and WHA. Volunteer roles may be subject to screening, orientation, or background checks appropriate to the role, particularly where the role involves working with youth.

9. Donations

Donations made through the Site are processed by Zeffy, a third-party fundraising platform. By donating, you also agree to Zeffy’s terms of service and privacy policy. WHA does not process or store your payment card information.

• Donations are voluntary and, unless otherwise specified, are unrestricted gifts that WHA may apply where the need is greatest.
• Donations to Wisconsin Hmong Association may be tax-deductible to the extent permitted by law. We are not able to provide tax advice; please consult your own tax advisor regarding deductibility.
• Refunds: Because donations are voluntary gifts, they are generally non-refundable. If you believe a donation was made in error or by mistake, contact us at wha@whainc.org and we will work with you in good faith to resolve it.
• If you set up a recurring donation, it will continue until you cancel it. You may cancel at any time through Zeffy or by contacting us.

10. Third-Party Sites and Services

The Site contains links to and content embedded from third-party websites and services that we do not control, including our donation platform and social media. We provide these for convenience only. We do not endorse and are not responsible for the content, accuracy, policies, or practices of any third-party site. Your use of those sites is governed by their own terms and policies.

11. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis for general informational purposes. To the fullest extent permitted by law, WHA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any content is accurate, complete, or current. Nothing on the Site constitutes legal, financial, medical, immigration, or other professional advice, and it should not be relied on as a substitute for consultation with a qualified professional.

12. Limitation of Liability

To the fullest extent permitted by law, WHA and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of your access to or use of (or inability to use) the Site, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless WHA and its directors, officers, employees, and volunteers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of the rights of any third party.

14. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookies Policy, which are incorporated into these Terms by reference.

15. Suspension and Termination

We may suspend or terminate your access to the Site, in whole or in part, at any time and without notice, if we believe you have violated these Terms or where necessary to protect the Site or its users.

16. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

17. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to the jurisdiction of those courts.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and WHA regarding the Site. Our failure to enforce any provision is not a waiver of that provision.
